Welcome to The Poster Mood! The terms "we", "us" and "our" refer to The Poster Mood, a brand operated by The MIUUS Studio sp. z o.o. The Poster Mood manages this store and website, including all associated information, content, features, tools, products and services, to provide you, the customer, with a carefully curated shopping experience ("Services"). The Poster Mood is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced in this document (collectively "Terms of Service" or "Terms"), describe your rights and responsibilities when using the Services.

Your order will not be accepted until The Poster Mood confirms acceptance. We must receive and process your payment before accepting your order.
Please review your order carefully before submitting it, as The Poster Mood may not be able to cancel it once accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you at the email address, billing address, and/or phone number provided at the time of ordering.

Prices, discounts, and promotions are subject to change without notice. In the event of a conflict between promotional terms and these Terms, the promotional terms shall prevail.

We are not responsible for shipping and delivery delays. All delivery timelines are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs clearance, or events outside our control. Risk of loss and title for products passes to you upon transfer of the products to the carrier. All other names, logos, and marks are the property of their respective owners. All rights not expressly granted herein are reserved by The Poster Mood.

You may have access to third-party tools through the Services which we do not monitor, control, or influence.
You acknowledge and agree that we provide such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools.

You should ensure that you are familiar with and approve of the terms under which tools are provided by the relevant third-party providers. The Poster Mood is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchase transactions are made directly with The Poster Mood. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale between you and The Poster Mood, including any injury, damage, or loss arising from the purchase of products or services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or relating to your purchases and transactions with The Poster Mood.

You also agree not to: (a) reproduce, duplicate, copy, extract, sell, or exploit any part of the Services; (b) collect personal information of others; (c) use spam, phishing, or pharming techniques; (d) use robots, spiders, scrapers, AI agents, automated devices, or any other automated or manual means to access the Services; or (e) interfere with or circumvent security or authorisation features of the Services. We reserve the right to suspend, disable, or close your account at any time without notice if we determine that you have violated any part of these Terms.

This section ("Agents") applies if you use, permit, enable, or commission an Agent to access, use, or interact with any of the Services. "Agent" means software or a service that takes autonomous or semi-autonomous actions on behalf of or at the direction of any person or entity, which may be executed on behalf of or using that person's device, without direct supervision.
No Agent may access, use, or interact with the Services unless it identifies itself and acts in strict compliance with the requirements set out in Section 14.4 below. No Agent may access, use, or interact with the Services if we have requested that the Agent refrain from accessing any of the Services.
We may restrict, including through technical means, whether and how an Agent accesses, uses, and interacts with the Services.
Agents are required to: (i) for all HTTP/HTTPS requests, identify that the request originates from an Agent and disclose the Agent's name by including the following string in the request: "Agent/[agent name]"; (ii) not conceal or obscure the fact that any access, use, or interaction originates from an Agent; (iii) respond truthfully to any questions or prompts intended to determine whether interactions originate from a human or a computer; (iv) not circumvent or otherwise evade any measures intended to block, restrict, modify, or control whether and how Agents access any consumer-facing Shopify service.

We reserve the right to terminate this agreement or restrict your access to the Services (or any part thereof) at our sole discretion at any time and without notice. You will remain liable for all amounts due up to and including the date of termination. The following sections shall survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

EXCEPT AS EXPRESSLY INDICATED BY THE POSTER MOOD, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
Section 17 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE POSTER MOOD, THE MIUUS STUDIO SP. Z O.O., OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS OF SHOPIFY AND ITS AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, OR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT.
Section 18 — Indemnification
You agree to indemnify, defend, and hold harmless The Poster Mood, The MIUUS Studio sp. z o.o., Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, or claims, including reasonable legal fees, made by any third party arising from or related to: (1) your breach of these Terms of Service or the documents incorporated by reference; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that failure to provide prompt notice will not relieve you of your obligations unless you have suffered material prejudice. We may control the defence and settlement of such claims at your cost, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld).
Section 19 — Severability
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms, without affecting the validity and enforceability of any remaining provisions.
Section 20 — Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect of the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt shall be void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice.
Section 22 — Governing Law
These Terms of Service and any separate agreements under which we provide Services to you shall be governed by and construed in accordance with the laws of Poland, where The MIUUS Studio sp. z o.o. is registered. You and The Poster Mood submit to the exclusive jurisdiction of the courts of Warsaw, Poland for resolution of any disputes.
